General Terms of Agreement

1.0 Overview

This agreement outlines the relationship between the Customer and Pexnode regarding the purchase or rental of services provided by Pexnode. The agreement is considered effective once the Customer submits an order through our website or client area.

2.0 Parties Involved

The Customer is defined as the individual placing the order and creating an account on Pexnode.

3.0 Contact Information

Pexnode assumes that the registered email address and anyone with access to the account password have the authority to manage all associated products and services. This authority includes modifications, upgrades, cancellations, and any other actions affecting active services.

The Customer is responsible for keeping their account information accurate and up to date through the client area. If access to the client area is unavailable, the Customer must contact Pexnode directly. It is the Customer's responsibility to ensure all information on file remains current.

4.0 Payment Terms

Payment is due at the time of ordering. Pexnode accepts payments processed through WHMCS using available payment methods presented at checkout. The Customer's chosen payment method will be charged upon order placement. Services are billed in advance on a recurring basis unless otherwise stated.

5.0 Delivery of Services

Services are considered delivered once the Customer gains access to their game server panel. Pexnode aims to provision all services automatically and immediately upon confirmed payment. In the event of a delay, the service will be delivered without unnecessary delays and no later than 30 days from the order date.

6.0 Termination of Services

The Customer is responsible for retrieving any data they wish to keep before terminating their service. Upon termination, all Customer data stored on Pexnode's infrastructure will be permanently deleted.

Customers can cancel their service at any time by logging into the client area and selecting the relevant service. Cancellation can be set to take effect immediately or at the end of the current billing period. All recurring charges will stop upon termination.

Pexnode reserves the right to refuse or terminate any order or agreement at its discretion.

7.0 Breach of Agreement

If the Customer fails to meet their obligations — including failure to make payment more than 14 days past the due date, violation of these terms, or misuse of services — Pexnode reserves the right to suspend or terminate the agreement immediately. This may result in service suspension and permanent data deletion without prior notice.

Payment obligations remain in effect for the full billing period even in the event of a breach.

8.0 Modifications to Terms

Pexnode reserves the right to update, modify, or change these terms, pricing, and service offerings at any time. For significant changes, Pexnode will provide at least 14 days' notice via email or through the client area. If the Customer disagrees with the changes, they must cancel their services within 14 days of the notification. Continued use of services after that period constitutes acceptance of the updated terms.

9.0 Late Payments

Services tied to overdue invoices may be suspended until full payment is received. If payment is not received within 7 days of the due date, Pexnode reserves the right to permanently terminate the service and delete all associated data.

10.0 Right to Withdraw

Customers who have not yet activated or used their service may request a full refund within 7 days of purchase. Each customer may use this option once. Custom configurations, dedicated IP addresses, and any bespoke setup work are non-refundable once delivered, as these are considered customized services.

11.0 Service Defects — Customer Rights and Complaints

Complaints must be submitted in writing to [email protected]. Pexnode will work to resolve reported defects within a reasonable timeframe. If a defect cannot be resolved after two attempts, the Customer may be eligible for a partial or full refund at Pexnode's discretion.

Game Server Terms

1.1 Overview — Game Servers

The following terms apply to all game server services offered by Pexnode, including but not limited to: Minecraft, Valheim, Rust, ARK, Palworld, DayZ, Hytale, Terraria, and 7 Days to Die. Any terms not defined in this section fall under the General Terms of Agreement above. Where specific terms conflict with general terms, the specific terms take precedence.

2.1 Uptime Guarantee

Pexnode guarantees 99.9% uptime on all game server infrastructure. In the event that this guarantee is not met, the Customer will receive a credit equivalent to one day of service for each hour of downtime, up to a maximum of one free month of service. The Customer must report any suspected uptime failures to [email protected]. Scheduled maintenance periods are excluded from downtime calculations.

3.1 Subscription

All game servers are offered as ongoing subscriptions billed in advance. If the Customer cancels after a new billing period has begun, they remain responsible for the full cost of that billing period. No partial refunds are issued for unused time within an active billing cycle, except where the right of withdrawal applies under Section 10.0.

4.1 Customer Responsibilities

The Customer is responsible for managing all aspects of their game server, including plugins, mods, configurations, and player management. Pexnode provides the infrastructure and access — server administration is the Customer's responsibility.

If the Customer's server activity causes disruption to other users or Pexnode's infrastructure, Pexnode reserves the right to suspend the service or request that the Customer cease the activity causing the issue. The Customer agrees not to use Pexnode's services for any activity that violates applicable law, infringes on third-party rights, or violates the terms of the game publisher.
